Terms of Use

1. These terms

These Terms of Use are an agreement between you and Tyler Brock Jardine, a sole proprietor doing business as Tidepass, the operator of Tidepass (“Tidepass”, “we”, “us”). They apply when you visit gettidepass.com, claim a pass, check in or leave a review. By doing any of those things, you agree to these terms and to our Privacy Policy.

Venues are also bound by the Venue Partner Agreement. Creators, hosts and businesses are also bound by the Partner Terms.

You must be at least 18 to claim a pass or leave a review. Children can come along on a pass an adult claims for the party. Venues set their own age limits for their experiences, and the adult who claims the pass is responsible for the children in their party.

2. How Tidepass works

Tidepass lists local experiences and gives you a pass at no charge, subject to the offer terms in section 3. You get the pass from us; you book, pay and do the experience with the venue. We don’t take your payment, and you don’t need an account.

  1. Pick an experience, a date and your party size, and get your pass.
  2. Book with the venue as usual. If the venue takes codes online, enter your pass code as the promo code.
  3. When you arrive, scan the venue’s check-in QR code (or tap “I’m here” on your pass after scanning). Your pass turns green.
  4. Show the green pass at the counter for $10 off (or the bigger discount your bill reaches, if the venue offers one), unless it was already applied online.

3. Pass rules

The offer: $10 off when your party spends $40 or more at the venue’s regular prices, before tax and tip. Alcohol doesn’t count toward the minimum and can’t be discounted. One pass per party, per venue, per day. No cash value; not for sale.

  • $10 off a total of $40 or more. The $40 minimum is your party’s total at the venue’s regular prices, before tax and tip.
  • Bigger discounts on bigger bills, at some venues. A venue may choose to offer larger discounts on larger bills (for example, $25 off $150 or more). The venue funds them, and they’re shown on the venue’s listing. The discounts shown when you claim a pass are locked onto that pass, even if the venue changes them later. You get the single biggest discount your party’s bill reaches, figured the same way as the $40 minimum: before tax and tip, not counting alcohol. Discounts don’t add together.
  • Alcohol is excluded. Alcohol doesn’t count toward the $40 and can’t be discounted, at every venue. You still get the $10 off everything else that qualifies.
  • One pass per party, per venue, per day.
  • Date only. A pass is valid only on the date shown. You can change the date before that day. Expired passes can’t be used.
  • No stacking. You can’t combine a pass with other venue discounts unless the venue says so.
  • Check-in required. You must check in at the venue for the pass to work.
  • No cash value. Not for sale. A pass can’t be sold, traded or exchanged for cash.
  • The venue’s terms govern the experience. The venue’s own booking rules, prices, availability, cancellation and refund policies, age limits, safety rules and waivers apply. You may have to sign the venue’s waiver.
  • Listings, prices and availability come from venues and can change. If a listing is wrong, the venue’s actual price and rules apply. Tell us so we can fix it.

If a venue won’t honor a valid, checked-in pass, tell us with the report link on your pass page or at support@gettidepass.com. We look into every report, and a venue that doesn’t honor passes can lose its ranking or its listing under our Venue Partner Agreement. We can’t force a venue to give you the discount, and because you don’t pay Tidepass anything, we don’t pay it to you ourselves. Your rights against the venue under consumer protection law aren’t affected.

4. You don’t buy anything from Tidepass

Passes cost nothing to get, subject to the offer terms in section 3. Any booking or payment is between you and the venue. Tidepass is not a party to that transaction, isn’t the seller of the experience, and can’t issue refunds for it. Ask the venue about refunds, changes and cancellations.

5. Venues are responsible for their experiences

Venues are independent businesses. They, not Tidepass, provide the experience, run their premises, train their staff, set their safety rules and carry their own insurance. We check venues before listing them and watch for venues that don’t honor passes, but we don’t operate, supervise or guarantee any experience. Physical activities carry risks. Follow the venue’s instructions and decide for yourself whether an experience is right for you.

6. Fair play, fraud and abuse

You agree not to:

  • Check in when you aren’t actually at the venue, or check in for a visit that didn’t happen.
  • Claim more passes than the rules allow, or use many devices, emails or networks to get around the limits.
  • Claim passes through your own creator or host link or code to earn on your own visits, or accept something of value to make fake visits.
  • Copy, sell or alter pass codes or check-in QR codes.
  • Scrape the site, overload it, probe it for weaknesses or interfere with how it works.
  • Use Tidepass for anything illegal, or to harass anyone.

We use automatic checks to spot abuse. If we believe a check-in is fake or a pass was misused, we may void the pass, cancel related referral credit and block devices, networks or people from using Tidepass.

  • Sponsored labels. Venues can pay for a Sponsored spot in Explore results or on the home page. Those spots are always labeled “Sponsored.” Paying never changes a venue’s place in the regular results, its trust score or its reviews and ratings.
  • Co-branded pages. Some pages show a business’s name, logo and colors (for example, a hotel’s page of local picks). These pages are operated by Tyler Brock Jardine as part of Tidepass, not by that business. Most businesses earn a commission when you visit through their link, which never changes your price. Some earn nothing (for example, because of their professional license, or because they share Tidepass with their own staff), and their page says so. A co-branded page doesn’t mean Tidepass or any venue endorses that business.
  • Ranking. Regular results follow one published formula for every venue. See How we rank venues.

7.1 Who owns Tidepass

Tidepass’s owner also owns Ragescape and Chopscape, two venues listed on the site. Those venues are marked “Owned by Tidepass’s founder.” They follow the same pass rules, fees, ranking formula and review rules as every other venue, and get no special placement. Because of this, Tidepass is not an independent reviewer of those two venues; their reviews come from checked-in guests under the same rules as everyone else’s.

8. Reviews

  • Checked-in guests only. You can review a venue only after checking in there with a pass. One review per pass.
  • Never bought or rewarded. We never pay for reviews, and nobody may offer you money, discounts or anything else for a review, or for changing or removing one. Don’t post a review you were paid or rewarded for.
  • No insiders. Staff, owners and their families may not review a venue they work at or own, or a competitor. We block reviews from accounts and devices linked to a venue. For venues owned by Tidepass’s owner, we also block devices linked to Tidepass’s own accounts.
  • Be honest. Write about your own experience. Don’t post anything false.
  • How it shows. Reviews appear publicly with your first name or initial, the venue and a “Verified visit” label.
  • Same moderation rules for every review. We don’t edit what you say. We remove or decline to publish a review only if it is: spam or advertising; hate speech, threats or harassment; personal information about anyone; off-topic (not about the visit); or written with a conflict of interest (such as by staff, owners, their families or competitors). We never remove a review for being negative. The same rules apply to every venue, including those owned by Tidepass’s owner. Venues may respond publicly.
  • License. You keep ownership of your review. You give Tyler Brock Jardine a non-exclusive, worldwide, royalty-free, perpetual license to host, display, reproduce, translate and share it (with your first name or initial) on Tidepass and in Tidepass marketing, and to let venues quote it about their own listing. You can ask us to remove your review; we’ll take it off Tidepass, but copies already shared may remain.
  • Your right to review. Nothing in these terms stops you from posting an honest review or opinion about Tidepass or any venue, here or anywhere else, and we will never penalize you for doing so.

8.1 Guest reviews of a stay

Hosts and lodging partners can show “Guest reviews” of their property on their Tidepass page. Tidepass collects these reviews; the host doesn’t.

  • Genuine guests only. A review link comes with a pass you grab from that host’s page, and each link works once. Reviews can’t be posted from the host’s own account or devices.
  • Say if you know the host. If you are related to, friends with or work for the host, tick the box and we label your review.
  • No rewards. Nobody may offer you anything for a review or for a particular rating. Hosts agree not to.
  • No suppression. Hosts can reply publicly but can’t edit, hide or delete reviews. Every published review counts toward the average shown, and all published reviews are listed, newest first. We remove a review only if it breaks a content rule: hate speech, threats or profanity; personal information; spam or advertising; off-topic; or not written by a guest. We never remove a review for being negative.
  • How it shows. Your first name, last initial, the month you stayed, your rating and what you wrote are public on the host’s page.
  • What “guest” means here. A review link shows that the reviewer got a pass from the host’s page. It doesn’t prove the reviewer stayed at the property, so these reviews are shown as “Guest reviews” and are never called verified stays. Don’t post a stay review unless you actually stayed there.
  • Removal. You can ask us to remove your own review at support@gettidepass.com. The license in section 8 applies to these reviews too.

8.2 Return-stay emails from hosts

Some hosts let you join their email list for offers on future stays. You join only by ticking a box and confirming by email. The list belongs to the host, who sends the emails and must follow anti-spam law. Every email must have an unsubscribe link, and you can also unsubscribe from the link in our confirmation email. Tidepass doesn’t send marketing to these lists.

9. Our site and content

Tidepass, its name, logo, design and content (other than venue and user content) belong to Tyler Brock Jardine or our licensors. You may use the site for your own personal, non-commercial use. Venue names, photos and descriptions belong to the venues.

10. Disclaimers

We work hard to keep Tidepass accurate and running, but the site and passes are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise the site will always be available or error-free, that every listing is accurate, or that a venue will have availability on your date.

Recommendations from creators, hosts and Business Partners are their own opinions. Most earn when you make a verified visit, and they are required to say so. Partners whose license doesn’t allow commissions earn nothing, and their pages say so.

11. Limitation of liability

To the fullest extent the law allows:

  • Tidepass is not liable for anything a venue does or doesn’t do, including injury, property damage or loss during an experience, or a venue’s refusal to honor a pass. Your claims about an experience are against the venue.
  • We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data.
  • Our total liability to you for any claim related to Tidepass is limited to $100.

None of these limits apply to, and nothing in these terms limits, our liability for our own fraud, willful injury to a person or property, gross negligence, or violation of law (whether willful or negligent), or any other liability or consumer right that California law doesn’t allow to be limited or waived.

12. Indemnity

If you break these terms or the law while using Tidepass, for example, by making fake check-ins or posting unlawful content, and someone makes a claim against us because of it, you agree to cover our reasonable losses and costs, including reasonable attorneys’ fees, to the extent the law allows.

13. Disputes

13.1 Talk to us first

Most problems can be fixed fast. Before filing a claim, email support@gettidepass.com with your name, a description of the problem and what you’d like us to do. We’ll both try in good faith to resolve it within 30 days.

13.2 Where disputes are heard

If we can’t resolve it, either of us may bring a claim in small claims court if it qualifies. Otherwise, claims will be heard in the state or federal courts located in San Diego County, California, and you and we agree to those courts’ jurisdiction. There is no arbitration requirement and no class-action waiver in these terms. Talking to us first doesn’t stop you from contacting a government agency at any time.

14. Governing law

California law governs these terms, without regard to conflict-of-law rules.

15. Suspension

We may suspend or block access to Tidepass, or void passes, if you break these terms or we reasonably suspect fraud. You can stop using Tidepass any time. Sections that by their nature should survive (such as reviews licenses, disclaimers, limits of liability, indemnity and disputes) continue after that.

16. Changes

We may update these terms. We’ll change the date at the top and, for big changes, post a notice on the site. Changes apply going forward. A pass you already claimed keeps the rules in place when you claimed it. If you keep using Tidepass after a change, you accept the new terms.

17. Other legal bits

If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a right at once, we haven’t given it up. You can’t transfer your rights under these terms. These terms, with the Privacy Policy, are the whole agreement between you and us about using Tidepass as a guest or visitor.

Assignment. We may assign these terms, without your consent, to a business we own or control (for example, a company formed to run Tidepass) or to a successor in a merger, sale or other transfer of the Tidepass business. Because guests don’t have accounts, we’ll give notice by naming the new operator on this page and in the site footer, and by email to anyone who has an account. The new operator takes on our side of these terms in writing; your rights don’t change, passes you already claimed keep their rules, and you can stop using Tidepass any time. We remain responsible for anything that happened before the assignment.
